H-1B Warning: Miss This Date and Your Application Could Be Gone

For the FY 2027 H-1B cap season if you miss a deadline it does not just slow down your H-1B application. It completely gets rid of it. The H-1B cap season has a system now with a wage-weighted lottery and a new fee of $100,000 for certain H-1B applicants. The H-1B cap season is really important now. The stakes, for the H-1B application have never been this high.

1. The Important Deadline That A Lot Of People Miss
When you are applying everyone knows about the last day to register but there is another deadline that is even more important and a lot of people miss it. This deadline is the 90 day period to file papers.
What this means is that if your name is picked in the lottery your employer has 90 days to send in the complete H-1B petition, which is the Form I-129 to the USCIS.
If the USCIS does not get your petition before the 90 days are over then you will lose your spot in the lottery. There is no way to get time and you cannot keep your spot for later. The H-1B petition is really important. You have to get it in on time. The 90 day filing window, for the H-1B petition is crucial.
2. Important Dates For The 2026 H-1B Cycle
April 1 2026 is the date when you can start sending in your H-1B petitions if you were selected.
This is a day for H-1B petitions.
June 30 2026 is the last day to turn in your I-129 petition, for H-1B.
October 1 2026 is the first day that your H-1B status can start and you can actually begin working with your H-1B.
3. What Happens If You Miss It?
Automatic Forfeiture: Your selection gets canceled away. USCIS does not give "grace periods" for filings.
No Second Chances: You cannot carry over your selection to the year. You have to re-enter the lottery in March 2027.
Loss of Fees: The $215 registration fee is small. Your employer may have already spent thousands on legal prep fees that you cannot get back.
4. Most people do not know this.
The 2026 cycle has a Wage-Weighted Selection System.
This system is different from years. In the past the lottery was completely random. Now it favors applicants with wages.These are Level 3 and Level 4 wages.
Here is a key point:
If your employer registered you at a Level 4 wage to boost your chances but then files your petition at a lower Level 2 wage to cut costs USCIS might deny or revoke your application.
They might say this is fraud.The wage level you registered with must be the same as the one, in your petition.
5. Mistakes That Cause Missed Deadlines
LCA Delays: Before filing the H-1B petition your employer must get a Labor Condition Application certified by the Department of Labor. This process takes around 7 to 10 days. I have seen many petitions miss the deadline because employers wait until June to start this process. It is really important to start the LCA process
Incorrect Filing Fees: There is a fee of $100,000 for certain H-1B beneficiaries who are outside the U.S. Or need consular notification. This fee was implemented in 2025. If you send a check, for the amount the entire package will be rejected right away. Make sure to double-check the fees before sending the payment.
Shipping Errors: Do not rely on mail to meet the June 30 deadline. If your package arrives on July 1 it will be too late. I would suggest using a shipping method to avoid missing the deadline.
